International Human Rights Law

In the immediate term, World Peace shows how steps to strengthen compliance with international law, improve collective action like international peacekeeping and peace-building, better regulate the flow of arms, and hold individuals legally accountable for acts of aggression or atrocity crimes can make our world more peaceful. In the long term, it shows that building strong, legitimate states that protect the rights and secure the livelihoods of their people, gender equal societies, and protecting the right of individuals to opt-out of wars can potentially establish world peace.

Human Rights After Hitler reveals thousands of forgotten US and Allied war crimes prosecutions against Hitler and other Axis war criminals based on a popular movement for justice that stretched from Poland to the Pacific. These cases provide a great foundation for 21st-century human rights and accompany the achievements of the Nuremberg trials and postwar conventions.

A constant yet oftentimes concealed practice in war has been the use of informers and collaborators by parties to an armed conflict. Despite the prevalence of such activity, and the serious and at times fatal consequences that befall those who collaborate with an enemy, international law applicable in times of armed conflict does not squarely address the phenomenon. The recruitment, use, and treatment of informers and other collaborators is addressed only partially and at times indirectly by international humanitarian law.

In this comprehensive and interdisciplinary work, the importance and application of the principle of adversarial process in multicultural and transnational contexts will be explored. The historical origins and theoretical foundations of this principle will be analyzed, along with the challenges and opportunities faced in diverse societies. The book presents emblematic case studies and relevant experiences that highlight how the adversarial process can be ensured in complex litigation and disputes of collective interest.
